About Motorcycle Accidents—Damages
Previous posts on this site have discussed some of the unique aspects of motorcycle accident cases. When a motorcyclist is involved in an accident, he or she faces insurance issues that other motorists don’t have to deal with. Motorcycle accidents also present unique liability scenarios, often involving motorists who simply fail to see motorcycles as they proceed on roadways. Besides these issues of insurance coverage and liability, however, there is another aspect of motorcycle cases that tends to be unique as well: the injury.
When lawyers discuss the injuries suffered by an accident victim, they are usually discussing the legal issue known as “damages.” When you bring an injury claim, you are seeking money damages (usually from the insurance company of the at-fault party). Those damages, generally speaking, should be proportionate to the injury you suffered. And in motorcycle cases, more often than not, the injury is serious.
Unlike car accidents, where the driver or passenger might walk away with a bit of neck or back pain but nothing more, a motorcycle accident is much more likely to leave the biker with very serious injuries: broken bones, severe abrasions and scarring, serious ligament damage, head injuries, and worse. Even an accident that would have been a minor “fender bender” if it involved two cars might result in terrible injuries if it involves a motorcyclist.
When you’ve been in a motorcycle accident, you are more likely to suffer life-changing injuries. Be sure to retain a lawyer who knows how to handle high-end, serious-injury cases, a law firm with extensive experience handling motorcycle injury cases.
